CPSIA Information

The Consumer Product Safety Improvement Act of 2008 (CPSIA) was passed by U.S. Congress and signed into law in 2008. CPSIA is designed to allow The U.S. Consumer Products Safety Commission (CPSC) to better regulate the safety of products made and imported for sale in the U.S. CPSIA also contains regulations that are intended to make products for children under age 12 safer by requiring manufacturers and importers to show that these products do not have harmful levels of lead and phthalates .

What is a children's product?

A children's product is one designed or intended primarily for children 12 years of age or younger. Toys, clothes, furniture, books, jewelry, blankets, games, CDs/DVDs, strollers, and footwear may all be considered children's products.

In determining whether a consumer product is “intended primarily” for a child 12 years of age or younger, the following factors will be considered:

• A statement by the manufacturer about the intended use of the product, including a label on the product, if such statement is reasonable.
• Whether the product is represented in its packaging, display, promotion or advertising as appropriate for use by children 12 years of age or younger.
• Whether the product is commonly recognized by consumers as being intended for use by a child 12 years of age or younger.

General Certification of Conformity (GCC)

The CPSIA requires the issuance of a General Certification of Conformity (GCC) for every consumer product that is subject to any safety rule, ban, standard, or regulation enforced by the CPSC. The GCC is required for all applicable consumer products manufactured on or after November 12, 2008. CPSC has issued a final rule requiring that all domestic manufacturers and importers provide the GCC. Products without the required certificate cannot be imported or distributed in commerce in the United States. The certificate must accompany the product or product shipment and must be available to CPSC and Customs and Border Protection upon request. Failure to furnish the certificate or furnishing a false certificate can subject the manufacturer or private labeler to civil and criminal penalties.

Third-Party Testing of Children's Products

The new legislation imposes an additional third-party testing requirement for all consumer products primarily intended for children twelve years of age or younger. Every manufacturer (including an importer) or private labeler of children's products must have its product tested by an accredited independent testing lab and, based on the testing, must issue a certificate that the product meets all applicable CPSC requirements.
